English Club Membership Terms and Conditions

 

English Club is a Program for learning the English Language. As used in this Terms of Service document, “Program” refers to the English Club Lessons, its Curriculum, its websites, and all content and software associated with it.

The Platform is operated by Trywarp Corporation, Wakuteku Space.

 

Section 1: The Enrollment Process

Fill up the online enrollment form and pay via recurring credit card payments or bank transfers. Please refer to section 2 for payment details. If you are enrolling more than two people, please fill up the form twice. 

You can come to the next class after we confirm the form registration and the payment.

Section 4: Rules & Obligation

  1. The Parents/guardians are required to give their child/children an English name they will use inside the classroom. 
  2. The children are not allowed to speak Japanese during lesson time. 

iii. Students shall follow the instructions of the teachers during lesson activities and textbook lessons. 

  1. No compensation for damages shall be claimed against the classroom, instructor, Wakuteku Space, and Trywarp Corporation in the event of an accident such as theft or injury outside the classroom, and/or an accident during transportation. It is the responsibility of each family to pick up and drop off children.
  2. We do not sell our teaching materials. Providing teaching materials to third parties is strictly prohibited.

 

Section 5: Cancellation of Class

In the event of a major disaster such as an earthquake, or due to the effects of weather such as typhoons and heavy snow, if it is judged that a safe school attendance cannot be secured suffecia\ently, the class will be canceled.

 

Section 6: Membership Withdrawal

  1. Customer’s Request

if you wish to withdraw from the membership, please contact us by the 10th of every month.

The membership will be withdrawn on the last day of the month of notification.

There is no monthly fee or admission fee refund. Also, please let us know if you want to transfer classes or change to online students after withdrawing from the membership.

  2. If there is a delinquency of 2 months or more regarding monthly tuition payments, etc., we may cancel the membership.
  3. For those who violate this agreement, those who cause a great deal of trouble to the classroom, and those who judge that it is difficult to continue learning, the English Club would have the right to cancel the membership.

 

Section 7: Handling of Personal Information

The program acquires or accumulates the following member information

  1. Information contained in the submitted materials such as the membership application form. We will use the information provided to create a list for monitoring purposes. The names of the guardian and the Japanese names of the Children will be confidential
  2. If a classroom has a ranking system to motivate kids, We may post the students’ English names along with their details relating to their performance in the class.
  3. Pictures or videos of Students in Classes. We may use the materials for the program’s publicity. If you do not want your pictures to be published, you need to contact us via [link] and fill up a separate form. If you do not accomplish the above-mentioned process, you are deemed to have agreed to such disclosure. 

 

Section 8: Disclaimer

  1. The method for motivating the students may differ according to the classroom’s needs.
  2. Our goal is to have our students attain the highest level of fluency through Language and culture exposure. However, we do not guarantee the results. Please read Section 8 if any dispute arises.

iii. Customer information is also stored in reputable third-party service providers like Google, Dropbox, etc.,

 

Section 9: Dispute Resolution and Arbitration.

To the extent permitted under the law of Japan, you agree to resolve any disputes arising from these Terms of Service or your use of the Platform through binding arbitration, which replaces the right to go to court. In the event of any dispute, claim, or controversy arising out of or relating to the membership of the program or these Terms of Service, you and the English Club agree to engage in good faith negotiations to resolve the issue. If the issue is not resolved through negotiation, either party may elect to have the dispute finally and exclusively resolved by binding arbitration. This arbitration agreement shall survive termination of these Terms of Service.

 

Section 10: Force Majeure.

We will not be liable or responsible for any failure to perform, or delay in performance of, any of our obligations under these Terms of Service that is caused by events outside our reasonable control, including but not limited to, acts of God, war, flood, fire, labor disputes, strikes, lock-outs, riots, civil commotion, malicious damage, explosion, governmental actions, and any other similar events.

 

Section 11: Changes to the Terms and Conditions

The English Club may change this agreement without the consent of the students and their parents. The changed membership shall apply from the date of notification or publication by online display or other methods deemed appropriate by the program.
